The Criminal Procedures Act, Act 51 of 1977, determines in Section 57, that an accused may without appearing in Court, admit guilt by paying the fine to the Clerk of the Court with jurisdiction. Upon doing this, the accused concerned, subject to the provisions of Section 57 (7), is deemed to have been convicted and sentenced by the Court in respect of the offence in question.

By electing to pay an admission of guilt, an accused waives several important procedural rights which such accused would have enjoyed at a trial, most notably the right to be sentenced only upon proof beyond reasonable doubt that the offence in question was committed.
